Dear MR. Douglas,

This letter is in regards to taking the roadway Toll of the northerly portion Newport Coast Drive as this road was originally built by the Irvine Company for LCP Road Mitigation. And is clearly shown in the Irvine Coast Development Agreement County of Orange June 9,1988. Exhibit C "Irvine Coast Local Coastal Plan Findings Of Approval And Supporting Documents" WHY ARE THE CCC FINDINGS NOT BEING FOLLOWED?

California Attorney General office opinion 93-1205 looked at the LCP issue in foot note 7. They relied on a letter from MR. Damm CCC Long Beach, to the city of Newport Beach wear he states "the portion of Newport Coast Drive where a toll is proposed is not in the coastal zone" His statement is in conflict with Documents he presented to Commissioners at the time of the LCP hearings, and the two page map in the Findings showing the road way layout for what to day is called Newport Coast Drive.

In October 18,1995 I mailed a letter to MR. Charles Dammm director of the CCC Long Beach office. Giving him additional information on my two Appeals to Orange County to follow the intent of LCP Mitigation regarding Newport Coast Drive as Road Mitigation. Copy of this 12 page letter enclosed.

The above is further fleshed out on page one of my letter (& web site) to our Attorney General now, MR Edmund G. Brown Jr asking for correction of opinion # 93-1205 by the A. G. Office in 1993. www.newportcoastdrive.com also a hard copy exhibit In this letter to you.

IN 1995 I paid $ 760.00 for each of two Appeals to County of Orange, the Board of Supervisors denied the appeal's. Wear I called out the County's fiduciary responsibilities to carry out the LCP, County Agreements regarding the Irvine Coast LCP Development Agreement Mitigation's.

Also the TCA did not follow CCC. Mark Delaplaine letter of February 1,1991 asking for "a detailed description of activities-- of their probable Coastal Zone effects", pleas look at Brown Letter page 13, exhibit 24. The TCA. Final Environmental Impact Statement for Rout 73 Extention "financed by tolls" -" the Corridor is consistent with the approval LCPs for Aliso Creek, Irvine Coast" ". Regarding the Irvine Coast this is just a FALSE STATMENT by the TCA. which lead to incorrect reviews of there requests for approvals from the CCC. page 13, exhibit 25.
